FDA is under the Executive branch, and it has a natural friction versus the Legislative branch, that’s why expecting FDA (Executive) to meet a fast deadline was dead before the ink even dried.

17 CCR § 23010. List of Intoxicating Cannabinoids.
(a) In addition to delta-8 tetrahydrocannabinol (THC), delta-9 tetrahydrocannabinol (THC), delta-10 tetrahydrocannabinol (THC), and tetrahydrocannabinolic acid (THCA), the following are included in the definition of “THC” or “THC or comparable cannabinoid” and include any metabolites, derivatives, salts, isomers, and any salt or acid of an isomer of:
(1) Delta-5 tetrahydrocannabinol (THC);
(2) Delta-6 tetrahydrocannabinol (THC);
(3) Delta-6a tetrahydrocannabinol (THC);
(4) Delta-7 tetrahydrocannabinol (THC);
(5) Delta-10a tetrahydrocannabinol (THC);
(6) Delta-11 tetrahydrocannabinol (THC);
(7) Delta-11-Hydroxy- tetrahydrocannabinol (THC);
(8) Exo-tetrahydrocannabinol;

New section filed 9-23-2024 as an emergency; operative 9-23-2024 (Register 2024, No. 39). Pursuant to Health and Safety Code section 11192.7(d), this section is exempt from the APA and OAL review for 18 months and is submitted to OAL for filing and printing only. A Certificate of Compliance must be transmitted to OAL by 3-23-2026 pursuant to Health and Safety Code section 11192.7(d) or emergency language will be repealed by operation of law on the following day.
